THE GEAR LOFT is committed to providing its visitors with a Service which respects their
privacy and meets their obligations under all applicable Canadian privacy legislation and
common law. This Privacy Policy applies to the personal data obtained when you interact
with THE GEAR LOFT through the use of the Service.
15. Personal data includes, but is not limited to, your email address, phone number, address,
sizing information, gender, age, pictures, IP address, analytics data, and other information
(the “Personal Data”).
Personal Data shall be collected, used, disclosed, and transmitted only for reasonable,
business-like purposes, under your consent, in the fulfillment of THE GEAR LOFT’s
contractual rights or obligations, in compliance with the applicable law and in accordance
with the principles established by this section.
Some Personal Data may be collected by third-party Service providers including but not
limited to advertising and analytics providers and may include cookies, log data, or web
beacons. When you access and use the Service, you agree that your personal information
shall be transferred to such third parties and will be subject to the privacy policy and
practices of such third parties.
Your Personal Data may be disclosed to certain third parties in specific situations such as:

a. Your Personal Data may be shared with third-party processors as required for THE
GEAR LOFT’s legitimate business interests, including the administration of the
Service, administration of your Account, contracting purposes, communication
purposes, for purchases/consignments, for delivery and shipping purposes, to identify
trends, protecting the security of THE GEAR LOFT, the Service and marketing
additional products and Services to you. The legal basis for disclosure of your
Personal Data consists of your consent to this Agreement, including this Privacy
Policy and THE GEAR LOFT’s right to protect and promote our legitimate business
interests.
b. For the engagement of third parties to perform various tasks and provide Services,
including, without limitation, hosting and maintenance Services, payment processing,
email delivery, customer relationship management, database storage and
management, background checks, identification verification, and direct marketing
campaigns. These third-party processors may not be disclosed if not required by law.
Your Personal Data will be shared with these third parties only to the extent necessary
to perform these functions and provide their Services, and only pursuant to binding
contractual obligations requiring such third parties to maintain the privacy and
security of your data.
c. In cooperation with government and law enforcement officials or private parties to
enforce and comply with applicable laws. Your Personal Data may be disclosed to
government or law enforcement officials or private parties as is determined, by THE
GEAR LOFT in our sole discretion, to be necessary or appropriate to respond to
claims, legal process (including subpoenas), to protect our property or rights or the
property or rights of a third party, the safety of the public or any person, to prevent or
stop any illegal, unethical, or legally actionable activity, or to otherwise comply with
applicable laws.
d. For the protection of THE GEAR LOFT, including to investigate and remedy any
violations of our rights, policies, or Agreements. Your Personal Data will be disclosed
as reasonably necessary to acquire and maintain insurance coverage, manage risks,
obtain financial or legal advice, or to exercise or defend against legal claims.
e. In the course of business transfers. THE GEAR LOFT may sell, transfer, or otherwise
share some or all of our assets, including your Personal Data, in connection with a
merger, acquisition, reorganization, or sale of assets, or in the event of bankruptcy. In
such transitions, customer information is one of the business assets that is acquired by
a third party. You acknowledge that such business transfers may occur and that your
Personal Data can continue to be stored, used, or processed as otherwise set forth in
this Privacy Policy.
f. For the promotion of the Service. THE GEAR LOFT may share your Personal Data
with business affiliates or advertisers or other third parties for the purpose of
conducting a general business analysis or the promotion of the Service for a

commission fee. Affiliates, advertisers, and other third parties must honour this
Privacy Policy. They are not allowed to spam you and must disclose they are an
affiliate. Advertiser, or third party for THE GEAR LOFT. If they do not do so, they
are in violation of this Privacy Policy, and any violation of this nature should be
reported to us using the contact information set out at the end of this Agreement.
g. For any other reason as required to comply with legal obligations or to protect your
interests or the interests of THE GEAR LOFT.

Your Personal Data may be processed by THE GEAR LOFT or a third-party processor as
necessary to administer, maintain, and improve the Service, enter into contracts with you and
fulfil the terms of such, keep records of transactions and interactions, comply with any other
legal obligations, obtain professional advice, and protect the rights and interests of THE
GEAR LOFT, third parties, and its Users.
Your Personal Data will be retained as long as it is required to conduct THE GEAR LOFT’s
reasonable business purposes, comply with applicable laws, comply with other legal
obligations, prevent fraud, resolve disputes, troubleshoot problems, assist with any
investigation, enforce this Agreement and those documents referenced by this Agreement, or
take other actions permitted or required by applicable laws. Your Personal Data will be
disposed of at the sole discretion of THE GEAR LOFT in a secure manner according to THE
GEAR LOFT’s internal data retention and deletion policies.
Your financial and billing information is not stored by THE GEAR LOFT. Your financial and
billing information will be transmitted through Wix and it is your sole responsibility to read
and understand Wix’s policies and agreements.
You may request the deletion of your data and THE GEAR LOFT will comply, unless THE
GEAR LOFT is required by law to retain the data. The retention policies of third parties are
beyond the control of THE GEAR LOFT and THE GEAR LOFT accepts no responsibility or
liability in relation to their retention of your data.
THE GEAR LOFT may create, maintain, store, process and archive information on servers
that are not located on the immediate premises owned by THE GEAR LOFT and may not be
located in British Columbia and the laws may not be the same as those in British Columbia
and may be deemed by other countries to have inadequate data protection. A foreign
government or entity may be able to access your Personal Data for lawful purposes. By
continuing to use the Service, you consent to the creation, maintenance, storage, processing,
and archiving of your Personal Data on third party premises whether in British Columbia or
another location.
By accessing and using the Service, you have given consent to the collection, use, and
disclosure of your Personal Data in accordance with this Privacy Policy. Once this consent
has been given, your Personal Data will continue to be collected, used, and disclosed for
purposes set out in this Privacy Policy without obtaining further written or verbal consent to

do so. Personal Data may also be collected, used, or without that individual’s consent as
permitted under applicable laws.

THE GEAR LOFT may, from time to time, employ the use of tracking technologies to
passively collect demographic information, personalize your experience on the Service, and
monitor advertisements and other activities. Such tracking technology may include, and is
not limited to, log files, cookies, web beacons
Log files log visitors to the Service. The information inside the log files may include without
limitation internet protocol (IP) addresses, browser type, Internet Service Provider (ISP),
date/time stamp, referring/exit pages, and the number of clicks. This information is used to
analyze trends, administer the Service, track User’s movement around the site, and gather
demographic information. IP addresses and other such information are not linked to any
information that is personally identifiable.
Cookies are small files transmitted by your computer. Web beacons store certain information.
Cookies may be used to authenticate your identity, to determine if you are logged onto the
Service, for personalization, for security, for targeted advertising, or for analysis of the
performance of the Service.

including without limitation Google Analytics and Facebook Pixels. The analytic companies
may also use cookies or other tracking technologies to analyze visitors’ use of the Service. To
access the Service, you must consent to the collection and use of your Personal Data by these
third-party analytic companies.
The Service may include links to other websites. THE GEAR LOFT cannot control third
party websites or Services and is not responsible for them. It is your sole responsibility to
read and understand third party policies and agreements. This Privacy Policy applies only to
the Service and the personal information collected directly through The Service.
Promotional and marketing communications will be sent only with your consent. You may
revoke your consent in writing by sending an email to info@thegearloft.ca. Notwithstanding
your right to revoke consent, THE GEAR LOFT retains the right to maintain a database of
past email subscribers and use this information as reasonably necessary in our business and
as provided by law.
The Website is not directed to Minors. THE GEAR LOFT does not knowingly solicit
personal information from Minors. If you have reason to believe that a Minor has provided

their personal information to us, please contact us at the contact information provided at the
end of this Privacy Policy, and we will delete that information.
If you submit any sensitive data to THE GEAR LOFT, via public postings, email
correspondence with us, or any other method, including social insurance number, social
security number, health data, genetic data, or information related to your ethnic origin,
religious beliefs, or criminal history, you are consent to THE GEAR LOFT’S use, storage,
and processing of this information in accordance with this Privacy Policy.
You have certain rights with respect to your Personal Data. THE GEAR LOFT retains the
right to charge you a reasonable fee for actions that you request be taken with respect to your
Personal Data. THE GEAR LOFT reserves the right to request that you provide us with
evidence of your identity before any action is taken with respect to the exercise of your
rights. Your rights may be restricted or nullified to the extent they conflict with THE GEAR
LOFT’s compelling business interests, the public interest, or the law.
You may update, confirm, change, transfer, delete, for any Personal Data you provided or
seek further disclosure about what data is held and for what purpose or seek to withdraw
consent for the collection, usage, or disclosure of your Personal Data, by making a request in
writing by email to info@thegearloft.ca. Upon request, THE GEAR LOFT shall provide a
copy of your personal data unless doing so would violate the rights and freedoms of others.
Your withdrawal or change of consent may result in your lack of access to the Service or the
termination of your Account.
You may opt out of future email correspondence or marketing, including third party
marketing, with THE GEAR LOFT by checking the appropriate box when you register for
the account or make a purchase. You may change your communication settings by contacting
THE GEAR LOFT in writing by email to info@thegearloft.ca.
You may restrict the processing of your data, such as when you contest the accuracy of your
data or when you have objected to processing, pending the verification of that objection.
When processing has been restricted, THE GEAR LOFT will continue to store your data but
will not pass it on to third-party processors without your consent, or as necessary to comply
with legal obligations or protect your rights or those of others or our company. You may opt
out of any processing of your data altogether. Changes to your consent given for processing
may impact your use of the Service
By consenting to this Agreement, you acknowledge that no security measure is foolproof and
that no method of data transmission over the Internet can be completely secure. THE GEAR
LOFT does not guarantee nor warrant the security of any Personal Data you have provided.
THE GEAR LOFT cannot prevent the interception, use, or misuse of your Personal Data by
other parties.
Your transmission of data to THE GEAR LOFT is at your own risk. Where data that you
have transmitted is password protected, you are responsible for keeping the password

confidential. You are exclusively responsible for any breaches of your data that results from
your own disclosure of or failure to protect your password.
THE GEAR LOFT will notify you if breaches of THE GEAR LOFT’s security occur and
your Personal Data is involved.

THE GEAR LOFT retains all rights to our intellectual property. This includes all content on
the Service (the “Service Content”) as well as THE GEAR LOFT name, logos, product or
Service names, slogans, trade dress, and any other THE GEAR LOFT trademarks or Service
marks (the “THE GEAR LOFT Trademarks”). Other than Services that are offered by
third party Service providers, including through links to third party sites, video, email,
telephone communication, and/or other offers outside of THE GEAR LOFT platform (the
“Third Party Services”), all Service Content is owned by THE GEAR LOFT or its licensors
and is protected by copyright, patent, trademark, trade secret, or other proprietary rights and
laws.
Reproduction or use of the Service Content, or any part thereof, is prohibited except with the
explicit permission of THE GEAR LOFT made in writing or as required by the applicable
law and THE GEAR LOFT retains all rights to the Service Content.

Third Parties

From time to time, third party Services may be accessible to you when using our Service.
THE GEAR LOFT is not responsible for such third party Services or content, and third party
Services will be governed by such third parties’ terms and conditions and policies. You are
responsible for reading and understanding any terms and conditions or terms of use policies
provided by any such third parties. This Agreement applies only to the Services offered by
THE GEAR LOFT.
You access third party Services accessible to you via the Service at your own risk. THE
GEAR LOFT disclaims any express or implied warranties as to the accuracy, validity, or
legality of materials, information, or other such content provided by a third party Service.
THE GEAR LOFT shall not be liable, directly or indirectly, for losses or damages of any
kind incurred as a result of, or in connection with the use of, or reliance on any content,
products, or Services available through such third party Services.
